The U.S. Commodity Futures Trading Commission (CFTC) today issued an Opinion and Order refusing registration with the CFTC for Zero Chaos Advisors, LLC and Ronald Edward Fisher.
Additionally, Zero Chaos and Fisher agree never to apply for CFTC registration or claim exemption from registration; and never to engage in any activity requiring registration with the CFTC, or act as a principal, agent, officer, or employee of any person registered or required to be registered with the CFTC. Fisher is a Georgia resident, and Zero Chaos has its principal place of business in Brookhaven, Georgia. Fisher is Zero Chaos’s founder, sole shareholder, and president.
The Notice alleged that on March 2, 2014, Fisher submitted applications to the National Futures Association (NFA) to register Zero Chaos with the CFTC as a Commodity Trading Advisor (CTA) and to register himself as an Associated Person (AP) of Zero Chaos and list himself as its sole principal. The Notice alleged that Fisher was statutorily disqualified from registration as a result of his 1998 conviction for bank embezzlement and based on false or misleading statements he made in the registration applications he filed on March 2, 2014, as well as in prior registration applications he filed four years earlier in March 2010. The Notice also alleged that Fisher was statutorily disqualified as a result of his lack of candor in responding to questions posed to him by the NFA, the futures industry self-regulatory organization that the CFTC has authorized to process registration applications. The Notice further alleged that Zero Chaos was subject to statutory disqualification based on the disqualifying conduct of Fisher, its sole principal.
The CFTC Order accepting their offer of settlement finds that Fisher’s application for registration as an AP of Zero Chaos is subject to refusal to register or conditional registration pursuant to Sections 8a(3)(D), (G), and (M) of the Commodity Exchange Act (CEA), and that Zero Chaos’s application for registration as an CTA is subject to refusal to register or conditional registration pursuant to Section 8a(3)(N) of the CEA.
